To use the SBOX AI App, you must meet the following eligibility requirements:
1.1. You must be at least eighteen (18) years of age at the time of usage.
1.2. You must have the legal capacity to enter into a binding agreement with SBOX AI.
1.3. If you are using the App on behalf of a company, organization, or other legal entity, you confirm that you have the authority to act on its behalf.
SBOX AI reserves the right to deny access to any individual or entity that does not meet these eligibility criteria.
2. Account RegistrationTo use our SBOX AI, you must first create an account with SDEC through the App. This registration process provides you with a unique user identity and enables us to trace any orders or queries related to your account. Access to certain features of the App may require you to complete the registration process, which includes:
2.1. Account Information: You agree to provide accurate, complete, and up-todate information during the user account creation process. This includes essential information such as your name (In App user display name), email address (verification for payment method linking in App), phone number (To receive OTP notification for verification and login), and payment information (for in app purchases). Providing false or misleading information may result in the suspension of your account. Your account is tagged directly to your SBOX AI App and all purchases will be caged to the payment method which you have linked to your account.
2.2. Account Security: You are responsible for keeping your login credentials confidential and for any activities that occur under your account. If you suspect any unauthorized access or notice suspicious activity, you must immediately notify SDEC upon becoming aware of such activity to safeguard your account.
2.3. Single Account Policy: Each user is allowed to maintain only one account. The creation of multiple accounts, especially for misuse or fraudulent purposes, is prohibited and may result in the suspension or termination of all related accounts. This includes, but is not limited to:
1. Account Sharing: Sharing account credentials or allowing multiple users on one account is prohibited and may lead to suspension or termination.
2. Duplicate Accounts: Creating multiple accounts to exploit promotions or rewards is forbidden. Duplicate accounts may be identified by IP, device information, or similar account data.
3. Abuse of Promotions: Repeated or excessive use of promotions, coupons, or loyalty points across accounts is prohibited and subject to review.
4. Exploitation of Refund Policies: Frequent or unjustified refund requests are considered abuse and may result in suspension.
5. QR Code Misuse: QR codes are for individual use only. Sharing or manipulating QR codes to gain unauthorized access is prohibited and may result in account suspension.
3. Usage of the AppThe App enables you to interact with SBOX AI located near you. By using the App, you agree to the following conditions:
3.1. Permitted Use: The App is intended for personal, non-commercial use. You may use it to browse available products, make purchases, track your transaction history, and receive notifications about special offers and promotions. The App is meant to enhance your shopping experience with SBOX AI.
3.2. Prohibited Activities: You must not use the App for any illegal, unethical, or fraudulent activities. This includes, but is not limited to, hacking, circumventing security features, manipulating transactions, or infringing on intellectual property rights. Any misuse of the App will result in immediate termination of your access and may involve legal consequences.
Technical Requirements: The App requires the use of a compatible device, such as a smartphone with internet access, and it is essential to keep the App updated to the latest version for optimal performance. It is your responsibility to ensure that your device meets these technical specifications to use the App without issues.
SDEC is committed to safeguarding your personal information and protecting your privacy. This document outlines how SDEC collects, processes and manages your personal data in accordance with the Malaysian Personal Data Protection Act 2010 (PDPA).
4.1. Type of Personal Information Collected by SDEC
SDEC collects personal data, defined in PDPA and refers to any information directly and indirectly related to you that is provided or collected by SDEC for specific purposes outlined in Section 4.5 of this Terms. This information may include:
i. Your full name as appears on your National Registration Identity Card (NRIC).
ii. Contact details (e.g. phone number, email address). This information may be required during payment binding in the app as to verify the user is indeed the cardholder as provided. An OTP (one-time-password) will be sent to either the phone number or email address of the registered cardholder for verification purposes.
iii. Payment method information.
4.2. Sources of Personal Information
Your personal data is collected directly from you by SDEC when you:
i. Complete the application or registration forms via the App.
ii. Interact with us through the “Contact Us” section or other communication channels (e.g., social media, emails, or phone calls). iii. Make a purchase using the SBOX AI, we shall collect information related to the transaction, including but not limited to product details, payment method, purchase history, and other relevant details.
This includes information you submit during account setup, profile creation, feedback, support requests, or other communication tools with us.
By using the SBOX AI, you consent to the collection and use of your Personal Information as outlined above.
4.3. Required Personal Information
All information requested on the relevant forms is mandatory unless otherwise indicated. Failure to provide the required data may prevent SDEC from processing your requests or providing you with services and features within the App.
4.4. Purposes for Collecting Your Personal Information
SDEC may collect and process your personal data in compliance with legal requirements and to facilitate your commercial transactions. This includes, but is not limited to:
i. Communicating with you regarding SBOX AI services.
ii. Processing payments for services and transactions.
iii. Conducting internal marketing analysis to better understand customer preferences and trends.
iv. Contacting you about products, services, promotions, marketing materials, or other information that may interest you.
v. Gathering data on your interaction with SBOX AI, such as the products you purchase, how often you make purchases, and your overall usage patterns.
4.5. Disclosure of Personal Information
i. Disclosure Within SDEC
Your personal data may be processed by authorized personnel within SDEC or its outsourcing partners. Only essential information is shared with employees or partners who are contractually obligated to handle your data in accordance with their job roles and responsibilities.
ii. Disclosure to Third Parties
Your personal information may be shared with third parties (both within and outside Malaysia) as required by law, under contractual obligations, or for the purposes mention in Section 4.4 of this Terms.
These third parties may include:
i. Service providers appointed by SDEC to perform tasks on our behalf.
ii. Law enforcement agencies.
iii. Relevant government bodies, regulatory authorities, and industry regulators.
iv. In the event of a business transaction such as a sale, merger, acquisition, or reorganization, your personal data may be disclosed or transferred to the relevant parties involved in the transaction, including their advisors and representatives.
4.6. Right to Access and Correct Personal Information
You have the right to access and correct your personal data held by SDEC, subject to certain exceptions. SDEC strives to maintain accurate and up-todate records of your personal information. If there are changes to your data, you may contact us to update your data or directly via the App in the
“Profile” section.
SDEC ensures compliance with data protection regulations while delivering a secure and personalized experience to you.
4.7. Data Collection and Privacy
Your privacy is a top priority for us. By using the App, you consent to the collection and use of your personal data in accordance with this policy. The key aspects of our data collection and privacy practices are as follows:
i. Location Data
With your consent, we may collect geolocation data to offer locationbased services. This allows us to notify you about nearby product availability, promotions, and personalized offers based on your current location.
ii. Data Security
We implement reasonable security measures to safeguard your personal data. However, no system can guarantee complete security, and you acknowledge that any data transmitted via the internet may be subject to interception or unauthorized access. By using the App, you accept these inherent risks.
5. Limitation of SBOX AI ServicesWhile every effort is made to ensure the App services are available at all times, there may be instances when access is temporarily unavailable. This could occur due to necessary repairs, routine maintenance, or the introduction of new features and services. During these times, access to the App may be disrupted. We strive to keep any downtime to a minimum and will work diligently to restore full functionality as quickly as possible.
6. Payment TermsWhen making purchases through the App, the following terms and conditions apply:
6.1. Accepted Payment Methods
The App supports various forms of payment, including credit cards, digital wallets, and other electronic payment methods. The availability of payment options may vary depending on the services provided.
6.2. Authorization of Payment
By completing a purchase, you authorize SBOX AI or its payment processor to charge the payment method you selected for the full amount of the transaction. This includes any applicable taxes, fees, or additional charges.
6.3. Refunds and Returns
i. Eligibility for Refunds and Returns
Monetary refunds for pre-authorization of RM 20 after purchases made through the SBOX AI are subject to the following conditions:
i. Refunds are available within 14-30 working days after purchase as Malaysia holiday season period might affect the refund process period as well.
ii. Refund date may be extended should there be a product complaint, or ticket issued by users,
iii. Valid proof of purchase is required, such as the digital purchase history through your SBOX AI account.
ii. Non – Returnable Items
Certain items are not eligible for return or refund, including but not limited to:
i. Perishable goods (e.g., dairy products, packed food, or other items with a limited shelf life).
ii. Discounted, sale, or items under certain promotions.
iii. Refund Process
i. Initiating a Refund
To initiate a refund, log in to your App, go to the “Purchase History” section, and click on the “Click to appeal” section if there is a problem with the order for the relevant item. There will be a description box in which you are required to state out the problems faced with the item.
ii. Processing Coupon Refunds
Once an eligible refund is processed and approved, the refund will be issued in the form of a coupon credited to your App account. Coupons can be applied toward future purchases within the App and are nontransferable and non-exchangeable for cash. The coupon amount will be equivalent to the original purchase price of the returned item, less any applicable fees.
iii. Partial Coupon Refunds
In certain cases, a partial coupon refund may be issued if the item has been opened or has missing parts. SDEC reserves the right to determine the amount of partial coupon refunds, which will be communicated to the customer upon inspection.
iv. Dispute Resolution for Refunds
In the event of a dispute regarding refund eligibility or amount, customers may contact SDEC’s customer support for assistance. SDEC reserves the right to make the final determination in line with this policy.
6.4. Transaction History
You can view a detailed record of your transactions within the App for your convenience. This history allows you to track purchases, payments, and other related activities. Please note the SDEC is not liable for any errors, issues, or disputes related to third-party payment processors involved in your transactions.
7. Intellectual PropertyThe App contains various forms of content, including information, data, software code, logos, graphics, text, and other materials (collectively referred to as “Content”). This Content is protected by copyrights, trademarks, and other intellectual property rights, which are owned either by us or by our authorized suppliers.
Modification, reproduction, copy, or distribution of any of the Content from the App for commercial purposes without obtaining prior written consent from us is prohibited. Any unauthorized use of the Content, or violation of the licenses or privacy policies, will be considered a breach of these Terms and may result in legal action.
8. Payment8.1. Linked Payment Method
All payments for purchases made through the App will be charged to the payment method that you have linked to your account. It is your responsibility to ensure that your linked payment method is valid and up to date.
8.2. Accepted Payment Methods
SDEC currently accepts payments only via VISA and MasterCard credit and debit cards. For customers using a debit card, a floating amount of RM 1 only will be placed on their account as it is to validate the relevant card itself during the binding process in the “Payment Method” section.
As for the customers that are purchasing the products from the SBOX AI, a pre-authorization hold of RM 20 only will be placed on their debit card to ensure that the card is active and has sufficient funds before completing a purchase. This pre-authorization hold is temporary and will be released within fourteen (14) to thirty (30) days, depending on the policies of your respective bank, once the transaction with SBOX AI is successfully processed.
8.3. Changes to Payment Methods
SDEC reserves the right to modify or change the available payment methods for products at any time. Any changes will be communicated to customers through the App, email notifications, or other appropriate communication channels. Customers should stay informed of such changes to avoid disruptions in their purchasing experience.
9. Limitation of Liability9.1. Exclusion of Liability for Damages
SDEC and its affiliates shall not be held responsible for any direct, indirect, incidental, or consequential damages resulting from your use of the App. This includes, but not limited to, any loss of profits, loss of data, or business opportunities. The App is provided on an “as-is” and “as available” bases, with no guarantees from SDEC regarding its availability, reliability, or performance. In any case where liability is established under these Terms, SDEC’s total liability shall be limited to the amount you paid, if any, for the App or related services.
9.2. Responsibility for Product Use
After purchasing products from SDEC, any damages or losses related to the products are entirely your responsibility. SDEC will not be liable for any damage or loss incurred post-purchase. You agree to handle and use the products with appropriate skill and care, and to refrain from using them for any unsuitable purposes. You assume full responsibility and all risks associated with the use, handling, and storage of the products.
9.3. Assumption of Risk for SBOX AI Services
By using SBOX AI services, you fully acknowledge and accept all associated risks. SDEC shall not be liable for any direct, indirect, consequential, or punitive damages arising from your use of or access to SBOX AI services. Additionally, SDEC shall not be responsible for any errors, omissions, or inaccuracies in the content of these services. This includes any damage or injury that may occur as a result of system errors, omissions, defects, delays in operation, or any other performance failures related to SBOX AI services.
10. Product Information and Billing10.1. Colour Representation
SDEC makes every effort to display the colours of products on the App services as accurately as possible. However, the colours you see on your screen or monitor may not perfectly match the actual colours of the products, as this depends on the specific display settings of your device.
Therefore, we cannot guarantee that the colours shown on your monitor will exactly reflect the real colours of the product.
10.2. Price Adjustments
If there is any difference between the price shown in your order on the App and the final bill, whether due to product substitutions, daily price changes, promotions, special offers, mislabelling, or pricing errors, SDEC reserves the right to modify the final bill accordingly. This right to adjustment remains valid even after you have received the initial online bill.
10.3. Purchase History
Once a transaction is confirmed, customers can review their failed or successful transaction via the “Purchase History” section as it can be accessed at any time via the App. We recommend that customers retain a personal copy (or screenshot) of the transaction in the “Purchase History” for future reference.
11. Promotions, Offers, and Discounts11.1. Availability of Promotions and Offers
From time to time, SDEC may introduce various promotions or special offers for the purchase of goods and services, or discounts off the regular prices, through the App. These promotions will only be valid during the specified promotional period and are offered on a “while stocks last” basis. SDEC retains the right to modify, cancel, or discontinue any promotion or offer at its sole discretion, without prior notice to you.
11.2. Usage of Promotional Codes and Coupons
If promotional codes or coupons (“Coupons”) are provided, they are strictly non-transferable and cannot be exchanged for cash. Each Coupon will be subject to specific qualifying terms, and their use may be restricted by applicable laws. Coupons are void where prohibited by law and may only be used in accordance with the stated terms.
11.3. Fraud and Misuse of Coupons
In any event that any fraudulent activity, misuse of a Coupon, or breach of these Terms is suspected, SDEC reserves the right to reject or cancel the use of the Coupon. Additionally, SDEC may charge you either partially or fully of the value of any benefits received through the misuse of the Coupon, using your registered payment method, and without further notice to you.
12. WarrantiesThe App is provided on an “as-is” basis, with no express or implied warranties. SDEC does not guarantee that the App will be available without interruptions, or that it will meet your specific needs. All implied warranties, including those of merchantability, fitness for a particular purpose, and non-infringement, are expressly disclaimed. Any use of the App is at your own risk, and SDEC is not liable for any errors, failures, or disruptions in the App’s functionality.
13. TerminationSDEC reserves the right to suspend or terminate your account and access to the App at any time for any reason, including but not limited to violations of these Terms, misuses of the App, and/or involvement in illegal activities. Upon termination, your access to the App will be immediately revoked, and any fees paid will not be refunded. Certain provisions, including those relating to data privacy, intellectual property, and liability, will survive the termination of your account.
14. Changes to Terms and App14.1. SDEC may update these Terms periodically. You are advised to review this page regularly for any updates. Notifications of changes will be made by posting the revised Terms on this page, and it will become effective immediately upon posting. Your constitute of the App following any updates constitutes your acceptance of the modified Terms.
14.2. SDEC has the right to update the App from time to time and it is the responsibility of the customers to keep the App updated accordingly to ensure a seamless user experience.
15. Governing LawThese Terms will be governed by and construed in accordance with the laws of Malaysia. Any legal disputes arising from or related to these Terms will be subject to the exclusive jurisdiction of the Malaysian courts located in Sarawak.
