Terms and Conditions for Byte N Go

1. Acceptance of Terms

By accessing or using the App, you confirm that you have read, understood, and agree to abide by these Terms. If you do not agree, you must discontinue use of the App and its services immediately.

2. Eligibility

You must use an active phone number with the Brunei country code and a valid email address. By using the App, you represent and warrant that these requirements are met.

3. Account Registration

To use Byte N Go, you are required to:

• Create and maintain an active account.
• Provide accurate, complete, and current information.
• Secure your login credentials and prevent unauthorized access.
• Notify us promptly of any suspected or actual breach of account security.

You are fully responsible for all activities that occur under your account.

4. Wallet, Payments, and Store Usage

Byte N Go provides a digital wallet system used to facilitate automated purchases at participating Stores.

4.1 Wallet Top-Up

You may load funds into your Byte N Go wallet using supported payment methods. All top-ups are final and non-refundable except as required by applicable law.

4.2 Store Entry and Shopping Process

You must scan the designated QR code or follow the required in-App authentication process before entering a Store.

While inside, you may collect any items you intend to purchase. Sensors and automated systems will track you and all selected items.

4.3 Auto-Payment and Linked Bank Accounts

If the total value of your selected items exceeds your wallet balance, you authorize Byte N Go to automatically deduct the outstanding amount from your linked bank account.

By linking a bank account, you grant Byte N Go permission to initiate such payments when necessary.

4.4 Transaction Records

All completed transactions, including wallet deductions and auto-payments, will be available in your in-App transaction history.

5. Fees and Charges

Service fees, if applicable, will be communicated clearly within the App prior to confirming any transaction. By proceeding, you agree to any such fees.

6. User Obligations

By using the App and Stores, you agree to:

• Use the App solely for lawful and authorized purposes.
• Refrain from tampering with store sensors, scanning equipment, or automated systems.
• Avoid attempting to bypass or manipulate the payment process.
• Maintain sufficient funds of $10 in your wallet or linked bank account to qualify for entry to "ByteNGo" and "ByteNGo Express", and also to cover purchases.

Any unauthorized or fraudulent activity may result in account suspension, civil liability, and/or legal action.

7. Data Protection and Privacy

Your personal information is collected and processed in accordance with our Privacy Policy, which forms part of these Terms. By using the App, you consent to our data practices as described in that policy.

8. Intellectual Property Rights

All intellectual property, including trademarks, logos, interface designs, software code, and related materials, are owned by or licensed to Byte N Go. You may not copy, distribute, modify, reverse engineer, or exploit any part of the App without our prior written consent.

9. Service Availability and System Integrity

While we strive to provide uninterrupted access, Byte N Go does not guarantee that the App or Store systems will be available at all times. Maintenance, technical failures, or third-party issues may result in temporary disruptions.

We are not liable for any loss or inconvenience resulting from such downtime.

10. Injury & Liability Disclaimer

10.1 Assumption of Risk

Customers enter and use the store premises at their own risk. While reasonable care is taken to maintain a safe environment, the Store does not guarantee that the premises will be free from hazards at all times.

10.2 Limitation of Liability

To the fullest extent permitted by law:

• Byte N Go is not responsible for losses arising from unauthorized use of your account due to your negligence or failure to secure your credentials.
• We shall not be liable for indirect, incidental, punitive, or consequential damages, including loss of data, revenue, or profits.
• The Store, its owners, employees, contractors, and agents shall not be held liable for any injury, loss, damage, or death suffered by customers while on the premises, including but not limited to slips, trips, falls, or accidents, except where such injury is caused by the Store's proven negligence or willful misconduct.
• Our total liability for any claim shall not exceed the total amount of service fees you have paid within the 12 months prior to the event giving rise to the claim.

10.3 Customer Responsibility

Customers are responsible for their own safety and must exercise reasonable care while in the Store, including following posted notices, safety instructions, and staff directions.

10.4 Children and Dependents

Parents or guardians are fully responsible for supervising children or dependents at all times while on the premises. The Store accepts no liability for injuries arising from lack of supervision.

10.5 Personal Belongings

The Store shall not be responsible for loss of or damage to customers' personal belongings unless required by applicable law.

10.6 Indemnity

Customers agree to compensate and hold harmless the Store from any claims, damages, or expenses arising from their misuse of the premises, violation of these Terms, or negligent conduct.

11. Suspension and Termination

We reserve the right to suspend or terminate your account without prior notice if we suspect:

• Fraudulent, abusive, or illegal activity.
• Violation of these Terms.
• Interference with Store systems or misuse of App functionalities.

You may close your account at any time by contacting our customer support.

12. Refund Policy

12.1 Wallet Top-Up Refunds

Wallet top-ups are non-refundable, except where required under the laws of Brunei Darussalam or in cases of confirmed system malfunction. Users may request a review of a disputed top-up by contacting customer support.

12.2 Transaction Refunds

Refunds for purchases made in Stores may be granted only under the following conditions:

• Incorrect charges for items not taken.
• System or sensor errors leading to inaccurate billing.
• Defective or damaged products, subject to Store-specific return policies.
• Refund limit: one time per month per Customer ID.
• A minimum refund amount of BND 10 and above shall apply.

12.3 Refund Processing

Approved refunds will be credited either to your Byte N Go wallet or replacement of selected item of the same value. Processing times may vary depending on partner financial institutions or bank card issuer.

13. Modifications to Terms

Byte N Go may update or revise these Terms periodically. Changes will take effect immediately upon being posted in the App. Continued use of such updates constitutes acceptance of the revised Terms.

14. Governing Law and Compliance

These Terms shall be governed by and interpreted in accordance with the laws of Brunei Darussalam, including but not limited to:

• The Electronic Transactions Order;
• Applicable Personal Data Protection guidelines and regulations;
• The Consumer Protection (Fair Trading) Order where relevant.

By using Byte N Go, you agree to comply with all applicable laws and regulations of Brunei Darussalam governing electronic payment systems, digital wallets, automated retail technologies, and consumer protection.
